On 23 July 2020, BaFin imposed administrative fines totalling 18,000 euros on SPOBAG Aktiengesellschaft.

The sanction related to breaches by SPOBAG Aktiengesellschaft of section 114 (1) sentence 2 of the German Securities Trading Act (WertpapierhandelsgesetzWpHG). SPOBAG Aktiengesellschaft failed to publish announcements, stating the date and the website on which the accounting documents listed in section 114 (2) of the WpHG for the financial years 2015 and 2016 were made publicly available in addition to their availability in the Company Register (Unternehmensregister).

On 3 August 2020, the company lodged an appeal against the administrative fine order.

Update (18.11.2020):

In light of new information provided by the company, the administrative fine order of 23 July 2020 has been revoked. On 10 November 2020, BaFin issued a new administrative fine order and imposed an administrative fine amounting to 10.000 euros.

The sanction related to a breach by SPOBAG Aktiengesellschaft of section 114 (1) sentence 2 of the German Securities Trading Act (WertpapierhandelsgesetzWpHG). SPOBAG Aktiengesellschaft failed to publish an announcement, stating the date and the website on which the accounting documents listed in section 114 (2) of the WpHG for the financial year 2016 were made publicly available in addition to their availability in the Company Register (Unternehmensregister).

SPOBAG Aktiengesellschaft may lodge an appeal against this administrative fine order.

Update (04.12.2020):

The administrative fine order is final and binding.
