On 9 December 2019, BaFin imposed administrative fines amounting to 150,000 euros against Elanix Biotechnologies AG.
The sanction related to breaches by Elanix Biotechnologies AG of section 115 (1) sentences 1 and 2 of the German Securities Trading Act (Wertpapierhandelsgesetz – WpHG).
Elanix Biotechnologies AG had failed to make its half-yearly financial report for the financial year of 2018 publicly available within the prescribed period.
Elanix Biotechnologies AG had failed to publish an announcement, stating the date and the website on which the half-yearly financial report for the financial year of 2018 was made publicly available in addition to its availability in the business register within the prescribed period.
On 20 December 2019 the company lodged an appeal against the administrative fine order.
Update (17 June 2020):
In light of new information provided by the company, the administrative fine order from 9 December 2019 as been revoked. On 26 May 2020 BaFin issued a new administrative fine order for the aforementioned breaches imposing reduced administrative fines amounting to 45,000 euros.
On 12 June 2020 the company lodged an appeal against the administrative fine order.
Update (07.11.2022):
On 28 September 2022, the Frankfurt am Main Local Court (Amtsgericht Frankfurt am Main) dismissed the appeal. The judgment is final and binding.
