Contents of the register of fee-based investment advisers
Pursuant to section 36c (1) of the German Securities Trading Act (WpHG), which entered into force on 1 August 2014, BaFin is required to set up a register of fee-based investment advisers. The register contains information on investment services enterprises or branches as defined in section 53b (1) sentences 1 and 2 or (7) of the German Banking Act (KWG) that are allowed to provide investment advice within the meaning of section 2 (3) sentence 1 no. 9 of the WpHG and that are eligible for the register.
The register contains the name of the investment services enterprises or the branches as well as their registered offices (street, postal code, city). Furthermore, it shows the date on which they were entered into the register.
Advisers who provide fee-based financial investment advice under section 34h of the German Industrial Code (GewO) are not entered in BaFin's register but in a register maintained by the Chamber of Commerce and Industry.
Notes on the register
The register of fee-based investment advisers is updated on a daily basis. BaFin enters an institution in the register upon the institution's request if it meets the requirements set out in section 36c (2) of the WpHG.
