As part of its international tasks, BaFin concludes cooperation agreements with supervisory authorities in other countries.
A cooperation agreement, also known as a Memorandum of Understanding (MoU), is a tried and tested building block for in-depth cooperation and the exchange of information between supervisory authorities.

By concluding such agreements, the supervisory authorities ensure their willingness to cooperate and define the modalities of international cooperation in compliance with national legislation (requests for assisstance). The agreements are not legally binding and do not generate rights or obligations that are enforceable in court, neither for BaFin nor for the foreign partner authorities and/or other third parties.

BaFin has signed both bilateral (MoU) and multilateral cooperation agreements (MMoU). Examples of MMoUs are the IOSCO MMoU (for securities supervision) and the IAIS MMoU (for insurance supervision). BaFin’s bilateral agreements for alternative investment fund managers to third countries (so-called AIFMD MoU) are published on the Website of the European Securities and Markets Authority (ESMA). In addition, BaFin has concluded bilateral agreements with various authorities, which can be viewed in the table at the bottom of the German version of this article. Please note that only MoUs that were concluded after the establishment of BaFin and whose publication has been approved by the partner authority can be viewed. Also note that the list is not complete yet and in the process of being updated.
