Three months wide usage period for applications for exemption from the obligation to set up the contingency mechanism

Under Article 33(6) of Commission Delegated Regulation (EU) 2018/389, BaFin is the competent authority for processing the applications of account servicing payment service providers for exemption from the obligation to set up a contingency mechanism for dedicated interfaces.

One of the preconditions for exemption under Article 33(6)(c) of Commission Delegated Regulation (EU) 2018/389 is that the dedicated interface has been widely used for at least 3 months. (known as the “wide usage period”).

As for the dedicated interfaces of the institutions or networks of institutions listed below, BaFin assumes, after completing its inspection of the application documents, that the institutions listed below fulfil the functional requirements of Commission Delegated Regulation (EU) 2018/389, which would enable them to commence the wide usage period of the dedicated interface.

On completion of the wide usage period, BaFin will decide whether to grant an exemption under Article 33(6) of Commission Delegated Regulation (EU) 2018/389.

Once an account servicing payment service provider has been granted such an exemption, the obligation to have a contingency mechanism in place for its dedicated interface no longer applies. Payment initiation service providers and account information service providers should therefore adjust their technical processes in order to ensure that they are prepared for this situation.
